Federal Court Mandates Freedom of Abrego Garcia from Immigration Custody
A federal judge has ruled the immediate release of Kilmar Abrego Garcia from immigration custody, finding his ongoing detainment lacks legal authority.
"Since his release after wrongful imprisonment in El Salvador, he has been re-detained, again without legal justification," the judge stated in her order.
The situation stems from a mistaken deportation to El Salvador in March, which US authorities later acknowledged was an mistake. After his repatriation to the United States to face alien smuggling allegations, he was detained in immigration detention.
In her order, the judge noted that the authorities does not have a valid removal order, which effectively blocks them from removing Mr. Abrego Garcia "at this time."
Context of the Legal Challenge
The legal proceedings involve disputed assertions. While the Trump administration contends that Abrego Garcia is a member of the MS-13 criminal organization, he categorically denies this allegation.
He has also pleaded not guilty to the smuggling charges, which are part of a separate trial in the state of Tennessee.
Terms of Release
The court, who was overseeing his challenge to deportation in a federal court, determined that he must now adhere to the conditions of his release from custody in Tennessee. This decision shifts his monitoring to the Tennessee court.
This ruling marks a notable development in a complicated immigration battle involving claims of wrongful detention and contested gang associations.
